By
His Excellency Lieutenant Colonel Andrew Ross, Acting Lieut. Governor in and

&c. and
The

Unto

His Excellence Lieutenant Colonel Andrew Ross, Acting Lieut. Governor in and
over the Colonies of Essequebo and Demerary and their Dependent Districts,
President in all Courts and Colleges within the same, &c. &c. &c.
and
The
Honble: Court of Policy of the said Colonies.
Unto
all whom these presents may or shall concern, Be it known:
Whereas
it has been represented to Us that much inconvenience may be expected to arise,
and is already in some degree experienced, from the prevailing practice of
Sinking the Hulks of condemned Vessels in different parts of this River close
to the shore, on account of its tendency to form Banks and consequently to
obstruct the Navigation of the River; - and having also considered the benefit
which might result to the Colony in general from sinking such Condemned Hulks
near Fort William Frederick in such manner as to contribute to its security
without any danger of producing the mischievous consequences now complained of.
We
therefore have thought fit to Order, and it is hereby Ordered accordingly, that
in future it shall not be permitted to Sink the Hulks of any Vessels condemned
in this Colony as not Sea-worthy, in any other place or situation but such as
shall have been pointed out, thro' the Harbour-Master, by the Governor, with
the concurrence of the Commandant of the Troops for the time being, on pain
that all Persons offending against the present Order, shall forfeit a Fine of
One Thousand Guilders, independent of the Condemned Hulk herself in respect to
which such Offence shall have been committed, and which shall be taken away or
destroyed for the use of the Public; it being understood however that nothing
herein contained shall be construed to interfere with the right of the Owners
of such Old Hulks to dispose of the upper works of the same as they may think
fit.
The
Pecuniary Fines herein before fixed to be divided as follows, viz: one third
for the Fiscal, one third for the Harbour-Master and the remaining third for
the Informer or Informers.
And
We do order the Harbour-Master, the Pilots and all others who it may concern to
pay ever attention to the present Ordinance and to report to the Governor every
future transgression thereof which may come within their observation.
And
that no ignorance may be pretended of this Ordinance, the same shall be
Published and affixed as customary.
Thus
resolved at Our Ordinary Session held in the Town of Stabroek in Demerary, on
the 31st October 1808, and Published the 12th November next thereto following.

President of all Courts and Colleges within the same, &c. &c. &c.
and
The
Honble. Court of Policy of the said Colonies.
Unto
all whom these presents may or shall concern, Be it known:
Whereas
We have taken into Our consideration that it is both equitable and conducive to
the Public good, that some compensation should be afforded in future to such of
the Inhabitants of these Colonies as may be deprived of the services of any of
their Slaves in consequence of the latter being sentenced to Death, Banishment
or Confinement for life, in the Public Work-House of the Colony.
We
therefore have thought fit to enact, and it is hereby enacted accordingly, that
every Planter or other Inhabitant of these Colonies who may in future be
deprived of the services of any of his Slaves from these being sentenced to
Capital Punishment, Banishment or Confinement for life in the Public Work-House
of the Colony, shall be entitled to receive from the Colonial Funds, as a
compensation for his loss, a Sum equal to the Value to be put on such Slave or
Slaves by the appraisers who shall be named for that purpose by the Court of
Justice either of Essequebo or Demerary by whom the Sentence on such Slaves
shall have been passed, provided nevertheless that such appraisement shall in
no case exceed the Sum of One Thousand Guilders, and provided also that it
shall not have appeared in the course of the Trial of such Slaves that ill
treatment or neglect on the part of their Masters had any share in leading them
to the commission of the crimes for which they are sentenced to suffer, as in
such a case the Proprietor of such Slave or Slaves shall never be entitled to
claim any compensation for the loss of their Property.
Thus
enacted at Our Ordinary Session held in the Town of Stabroek in Demerary on the
3d November 1808, and Published on the 12th of the same Month.
